Please read them carefully

The use of this site is governed by the TERMS AND CONDITIONS AGREEMENT OF SALE set forth below. Your use of this site or purchase from MCoBeauty Pty Limited indicates your acceptance of these terms and conditions.

MCoBeauty Pty Limited reserves the right to make changes to this web site and these terms and conditions at any time without any prior notice.

MCoBeauty Pty Limited is the service provider; it is also referred to as “MCoBeauty”, “us” and “we”.

The customer is the person or organization who purchases or seeks services from ModelCo; it is also referred to as “you”.

PLACING ORDERS

All orders placed are subject to confirmation and acceptance by ModelCo Pty Limited.

ModelCo Pty Limited may vary prices for received orders in the event of price changes. In the case of price increase, you may cancel the order by giving notice to ModelCo, which must be received within seven days of the price increase notification.

To minimize errors and improve efficiency, orders should be placed using our on-line ordering system whenever possible. Other forms of ordering are accepted only if our on-line ordering system is malfunctioning or you have difficulty using it. Other ordering methods include E-mailing our sales or submitting the order by fax. Unfortunately, we do not accept phone orders. For some organizations where a purchase order is necessary, we still encourage the orders to be placed on-line and followed by a summarized purchase order.

Quantity in stock does not take into account the orders already placed which are yet to be processed. It is possible that an order placed earlier will receive the allocation of the part in which the quantity for it showed as in stock at the time of your order. Inventory discrepancy can also affect the accuracy of the stock status displayed on our web site.

Any attempt to cancel an order must be made as soon as possible. Cancellations attempted after the dispatching will result in the customer having to pay the shipping and handling charges on the package and the cost of shipping the package back.

Cancellations may be communicated by email or Fax.

For online orders, accepted payments include credit cards (Visa/ Master card/Bankcard ONLY)
The title of the goods supplied does not pass to the customer from MCoBeauty until the full amount is paid to MCoBeauty Pty Limited.

SHIPPING AND RETURNS

MCoBeauty ships Monday – Friday, excluding US public holidays. Orders placed after 9am EST are processed the following business day. Due to the high volume of orders during launch periods and promotions, processing and shipping timelines may be slightly delayed during these times. Our team are working hard to make sure you get your MCoBeauty items as soon as possible.

MCoBeauty domestic orders are delivered via UPS standard within 3-5 business days. Please allow for an additional 1-2 days transit for regional areas. To ensure secure delivery, all parcels must be signed for upon receipt. If you don’t expect to be home during normal business hours, please choose a delivery address where someone will be available to sign for your parcel.

When will my order ship?

Please allow 1-2 business days for order processing (orders placed after 9am EST are processed the following business day). Once processed, you’ll receive an email, inclusive of tracking number. Please be advised that during sale period orders can take up to 3 business days to process.

Where is my order?

Once your order is shipped you will receive a confirmation email from MCoBeauty.com which will include your UPS tracking number.

You can track the progress of your order through to shipment by visiting UPS and entering your tracking number.

If you are unable to locate your tracking number, or if you have any questions about your shipped order please reach out to our MCoBeauty customer service team at info@mcobeauty.com.au and we will assist you with your enquiry.

I’m having problems with my tracking.

In some cases, the carrier takes 1-2 business days to register your shipment status via their website. If your tracking number isn’t populating after 1-2 days, please reach out to the MCoBeauty customer service team at info@mcobeauty.com.au.

We do not ship to third party addresses unless that address is known and can be verified by MCoBeauty.

Customers are responsible for paying any freight charges incurred by refused shipment and unclaimed goods. Likewise, customers are responsible for paying any additional customs or duties charges that may be incurred on their order.

MCoBeauty will make every effort to deliver on time. However, we shall not be held liable for delayed or lost shipments.

Customers are responsible for ensuring someone is at the delivery address to sign for and accept the delivery. The cost for re-delivery attempts will be absorbed by the customer if the delivery address is unattended at the time of delivery, or if incorrect details are provided during the checkout process & not amended prior to dispatch.

RETURNS AND REFUNDS

If you have purchased items(s) from our skincare range, we do not offer a refund if you have changed your mind, however we offer a 30 day return (from the day of purchasing) if the product is faulty. If your item is faulty please email info@mcobeauty.com.au with pictures and a description of the fault and our customer service team will assess your enquiry and send a replacement item if required. This policy only applies to purchases made directly with mcobeauty.com. With relation to all items purchased from a retailer or e-tailer, their specific returns policies applies.

We do not refund for change of mind. We do not exchange colours for change of mind. Returns for refund will only be accepted if the product is faulty, received in error or differs dramatically from the description supplied by MCoBeauty.

We may accept returns for other reasons at our discretion. Returned goods must be in its original condition and include all the original packaging. If you believe your product is faulty or you wish to return your goods for other reasons, please email our customer service department – include as many details as possible about the order and the issue with the goods.

Shipping and handling costs are non-refundable. Any goods returned are the customer’s responsibility until they reach our warehouse. Please ensure you package your return to prevent any damage to the goods or packaging. We are not responsible for any goods that are returned to us in error. We recommend the use of a postal service that insures you for the value of the goods being returned.

Faulty items will undergo an inspection process by our product development team and you will be contacted with a resolution. If the goods are deemed faulty, we will replace or refund the product free of additional freight charges.

MCoBeauty does not take responsibility for the costs involved with returning faulty goods. However, if the goods are deemed faulty after assessment, postage costs will be refunded thereafter. Please include original postage receipt in return parcel.

Our returns policy only covers the items purchased from mcobeauty.com. We do not accept returns on overly used products or products not purchased directly from mcobeauty.com. Please contact the original seller if you have any problems with goods not purchased directly from MCoBeauty.

A large percentage of returned goods are found to be not faulty. If the returned goods are determined by MCoBeauty to not be faulty, then all returning shipping fees will be worn by the customer. We will seek permission from the customer to charge additional costs to the customer’s credit card where possible. MCoBeauty also reserves the right to charge the labor cost for examining these goods where no fault was found.

If the item(s) received is not what was ordered please do not open the sealed package in which it was sent. Any attempt to use the incorrect item will be deemed to be acceptance by the customer of the item(s) as a satisfactory substitute for the one that was ordered and no further claim can be raised thereafter.

If you are granted a refund we will refund the price paid by you for the goods (exclusive of the initial delivery charge) within thirty (30) days of receiving your original notification that you would like to return the goods.

Refunds will only be made to the original credit/debit card used for purchase.

Please note that we cannot accept returned goods that we reasonably believe have been used. In such circumstances, we will notify you that no refund will be available and you will be responsible for arranging redelivery within 14 days.

MCoBeauty owns the title of any extra goods shipped with your order that have been dispatched in error.

There will be no credit given on order price difference, due to price drops or promotions. Promotional codes cannot be applied after an order has been placed.

WARRANTY CLAIM

All goods sold by MCoBeauty come with a warranty to be free from any defects or faults. This warranty is not transferable.

Goods under warranty cover will be replaced or repaired by the manufacturer. No refund can be provided under any circumstances.

Warranty only covers the item(s) sold by MCoBeauty.

A large percentage of returned goods are found to be, not faulty. If the returned goods are determined by MCoBeauty to not be faulty, then all returning shipping fees will be worn by the customer. We will seek permission from the customer to charge this cost to the customer’s credit card where possible. Failing this, the goods will be sent back by Australia Post COD freight collected. MCoBeauty also reserves the right to charge the labour cost for examining these goods where no fault was found.

All warrantees are voided if returned product is found in any way to be mishandled, misinstalled, modified, tampered, abused, physically damaged.

Please attach a copy of the original invoice or provide the original invoice number. A detailed fault description sheet must be sent together with all the returning warranty goods.

Customer is responsible for any shipping and insurance cost involved in sending the warranty claim goods back to MCoBeauty. MCoBeauty is not responsible for any parcel missing in transit, on its return back to MCoBeauty.

Products sold by unauthorized dealers are non-returnable and are not covered by the manufacturer’s warranty.

Due to changing market forces and other extenuating circumstances that affect product availability, and price stability we reserve the right to withdraw any product we advertise and change prices without notice.

TERMS AND CONDITIONS

NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN.  A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

MCoBeauty Inc. (“Sponsor”) hereby offers the MCoBeauty Time Square Billboard Contest (the “Contest”) subject to these certain Terms and Conditions (“Terms and Conditions”):

1. Contest Period. The entry period for the Contest begins at 08:00 AM Eastern Time (“ET”) on May 16, 2025 and ends at 11:59 PM ET on May 31, 2025 (the “Entry Period”). All times are measured by Eastern Time (“ET”). Sponsor’s designated clock shall be the official timekeeper for the Contest.
2. Eligibility.  Only legal residents of the United States, excluding Rhode Island, who are eighteen (18) years of age or older at the time of entry may enter the Contest.  Proof of residency and age may be required prior to award of any prize.  Employees of Sponsor and its subsidiaries, divisions, affiliates, and advertising or promotional agencies, and the immediate family and household members of such individuals, are not eligible to enter or win.  The Contest is subject to all applicable federal, state and local laws, and is void in Rhode Island and where prohibited by law. In order to enter the Contest or receive the prize, you must fully comply with the Terms and Conditions and, by entering, you represent and warrant that you agree to be bound by these Terms and Conditions and the decisions of the Sponsor, whose decisions shall be binding and final in all respects relating to this Contest.

3. How to enter.  During the Entry Period, to receive one (1) entry into the Contest (an “Entry”), (i) follow @mcobeauty_us on TikTok; and (ii) post a TikTok “get ready with me” post (the “Post”) in which you feature and use MCoBeauty products, tagging @mcobeauty_us in the Post.

ALL ENTRIES MUST BE RECEIVED BY 11:59 PM ET ON May 31, 2025. Although it is free to enter, standard data rates and charges may be incurred if you use your mobile device to enter the Contest.  Limit one (1) Entry per person throughout the entire Entry Period.  Entries will be deemed to have been submitted by the authorized account holder of the email address associated with the TikTok account from which entry is made at the time of the entry.  “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or organization that is responsible for assigning email addresses for the domain associated with the submitted email address.  Any attempt to enter more than the permitted number of times in any Contest with multiple identities, email addresses, social media accounts, or by any other means, may result in disqualification. Use of any macro, bot, script or other automated means to submit entries is prohibited. All submissions become the property of Sponsor upon receipt and will not be acknowledged or returned.

All images, text, photos, video or other content (“Content”) you post or submit in connection with your entry must comply with TikTok’s terms for acceptable content and, without limiting the foregoing, must meet the following requirements: (a) be your exclusive original work;  (b) be in keeping with the Sponsor’s image, (c) not defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon the rights of any person or entity, including but not limited to copyright, trademark, privacy or publicity, (d) not contain any commercial/corporate advertising, including but not limited to corporate logos, brand names, and slogans other than the Sponsor’s, (e) not depict any conduct or content that is unsafe, immoral, obscene or otherwise inappropriate as determined by Sponsor in its sole and absolute discretion (including but not limited to hate speech, pornography, profanity, or discrimination [based on race, gender, ethnicity, religion, disability, sexual orientation, political orientation, citizenship, ancestry, marital status, or age]); (f) not have been submitted in any other promotion won any prize; and (g) not contain, facilitate, or use material which promotes, suggests, or encourages gambling in any form.

You represent and warrant that you have obtained permission from any and all recognizable persons other than yourself depicted or mentioned in any Content you post and agree, upon request, to furnish written proof of such permission.  Failure to meet any of the requirements above, or to otherwise comply with these Terms and Conditions, may result in disqualification.  Sponsor reserves the right to delete or blur any inappropriate content from a submission without disqualifying the entry where, in Sponsor’s determination, such change does not materially alter the submission and the entrant has otherwise attempted in good faith to comply with these Terms and Conditions.

4. Selection of Winner.  After the close of the Entry Period, Sponsor will take all Entries into consideration and will use the following judging criteria for each Entry to select on (1) winner of the Contest (the “Winner”):
5. Creativity: How original each Entry’s concept is, assessing whether the format of each Entry is unexpected, clever, and unique;
6. On-Camera Presence: If the individual in the Entry is engaging, confident, energetic, and entertaining; and
7. Makeup Execution: How well-executed the makeup and looks are, aesthetically and from a skill-based perspective.
8. Prize.  The Winner will receive an opportunity to be featured on the New York Times Square Billboard, along with the opportunity to participate in three (3) collaborations with Sponsor (the “Collaborations”). The Winner shall also receive MCoBeauty products to be provided by Sponsor. The total prize amount, inclusive of the Collaborations, products, and potential travel expenses shall not exceed USD $4,500.

Any and all federal, state, local, and other taxes on the prize and any other costs and expenses associated with prize acceptance and use not specified herein as being provided, are the sole responsibility of the Winner. A 1099 tax form will be issued to the Winner, and the Winner agrees to provide Sponsor with Winner’s tax information as reasonably requested by Sponsor. Prizes are non-transferable and no cash equivalent or substitution is offered, except at the sole discretion of the Sponsor or where required by law. No transfer, refund, cash redemption, substitution or replacement of the prize or any prize component permitted, except that Sponsor reserves the right, in its sole discretion, to substitute a prize of equal or greater value (or cash equivalent), including the substitution of products and/or shades of products based upon availability. The Winner must be able to participate in the Collaborations on date(s) and time(s) as selected by Sponsor. In no event will more than one (1) prize be awarded. By accepting the prize, the Winner agrees not to disclose or reveal to any person that he/she has been selected as the winner and/or any details about the prize or prize components until advised by the Sponsor – failure to adhere to the foregoing may result in disqualification. ARV of the prize is in U.S. dollars.

6. Winner Notification.  The potential winner will be contacted between May 31, 2025 and June 9, 2025 via TikTok direct message and: (1) must respond within twenty-four (24) hours of initial outreach by Sponsor to be eligible for winnings; and (2) may be required, in Sponsor’s discretion, to complete and return a Declaration or Affidavit of Eligibility, Release of Liability and Publicity Release (where permitted by law), and submit to and pass a standard background check (collectively, the “Affidavit”) by the date or within the time frame specified by Sponsor, or an alternate winner may be selected. If potential winner is under the age of majority in winner’s state of legal residence, the Affidavit must be executed on its behalf by its parent or legal guardian. In the event: (a) a potential winner cannot be reached for whatever reason after a reasonable effort has been exerted or winner notification or Affidavit is returned as undeliverable, (b) a potential winner declines or cannot accept, receive or use the prize for any reason, (c) of noncompliance with the above or within any of the aforesaid time periods, (d) a potential winner is found to be ineligible to enter the Contest or receive the prize, (e) a potential winner cannot or does not comply with the Official Rules, or (f) a potential winner fails to fulfill the Affidavit-related obligations, the potential winner shall be disqualified from the Contest and an alternate potential winner may be selected, at Sponsor’s sole discretion, from among the other eligible entries received.

The Winner will be announced on @mcobeauty_us as a TikTok story and in Paragraph 11 of these Terms and Conditions on June 9, 2025.

7. Publicity Release; Use of Personal Information. Except where prohibited or restricted by law, a winner’s acceptance of prize constitutes the winner’s agreement and consent for Sponsor and any of its designees to use and/or publish winner’s name (in whole or in part), TikTok handle, city and state of residence, photographs or other likenesses, pictures, portraits, video, voice, testimonials, biographical information (in whole or in part), and/or statements made by winner regarding the Contest or Sponsor, worldwide and in perpetuity for any and all purposes, including, but not limited to, advertising, trade and/or promotion on behalf of Sponsor, in any and all forms of media, now known or hereafter devised, including, but not limited to, social media, print, television, radio, electronic, cable, or World Wide Web, without further limitation, restriction, compensation, notice, review, or approval. By entering, you warrant and represent that your Content has been created by you as an original work and that all required third-party releases (if any) have been obtained in writing, and you further agree acknowledge and agree that Sponsor (and those acting with its authorization) may copy, reproduce, edit, broadcast and otherwise use the Content and your post in any way in any medium whether now existing or later discovered, worldwide, in perpetuity, including but not limited to posting online on Sponsor’s social media pages. Sponsor reserves the right to remove or reject any content it deems inappropriate for any reason.  By entering the Contest, entrants will be sharing their personal information with Sponsor, which personal information will be collected and be used for administration of the Contest and awarding the prize. In addition, by entering, entrants agree to Sponsor’s use of entrant’s personal information as described in its privacy policy at https://us.mcobeauty.com/pages/privacy-policy. Please refer to Sponsor’s privacy policy for important information regarding the collection, use and disclosure of personal information by Sponsor.  Sponsor is not responsible for disclosures made by any third party.
8. No Tampering; Right To Cancel; Modify.  Sponsor and its subsidiaries, affiliates, divisions, partners, representatives, agents, successors, assigns, employees, officers, directors and members shall not have any obligation or responsibility, including any responsibility to award any prize to entrants, with regard to: (a) entries that contain inaccurate information or do not comply with or violate the Terms and Conditions; (b) entries, prize claims or notifications that are lost, late, incomplete, illegible, unintelligible, damaged or otherwise not received by the intended recipient, in whole or in part, due to computer, human or technical error of any kind, including but not limited to, spam filters, privacy settings, inactive email or social media accounts or an entrant’s failure to monitor its spam folders and/or email and/or social media accounts; (c) entrants who have committed fraud or deception in entering or participating in the Contest or claiming the prize; (d) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties; (e) any inability of the winner to accept the prize for any reason; (f) if a prize cannot be awarded due to delays or interruptions due to Acts of God, natural disasters, terrorism, epidemic, pandemic or outbreak of communicable disease, quarantine, national, regional or state of emergency or emergency disaster, weather or any other event beyond Sponsor’s reasonable control; or (g) any damages, injuries or losses of any kind caused by any prize or resulting from awarding, acceptance, possession, use, misuse, loss or misdirection of any prize or resulting from participating in this promotion or any promotion or prize related activities. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be (a) tampering with the entry process or the operation of the Contest, or with any website promoting the Contest; (b) acting in violation of the Terms and Conditions; or (c) entering or attempting to enter the Contest multiple times through the use of multiple email addresses/Instagram accounts/TikTok accounts or the use of any robotic or automated devices to submit entries. If Sponsor determines, in its sole discretion, that technical difficulties or unforeseen events compromise the integrity or viability of the Contest, Sponsor reserves the right to void the entries at issue, and/or terminate the relevant portion of the Contest promotion, including the entire Contest promotion, and/or modify the Contest and/or, in the event of termination, award the prizes in a random drawing from all eligible entries received as of the termination date.
9. Release of Liability; Disclaimer of Warranty; Forum Selection Clause.  By participating in the Contest, entrants and winner(s) agree to release and hold harmless Sponsor, and its respective parent companies, subsidiaries, affiliates, divisions, partners, representatives, agents, successors, assigns, employees, officers, directors and members (the “Released Parties”), from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever, including without limitation, property damage, personal injury (including emotional distress), and/or death, which may occur in connection with preparation for, or participation in, the Contest, or possession, acceptance and/or use or misuse of the prize or participation in any Contest-related or prize-related activity and for any claims or causes of action based on publicity rights, defamation or invasion of privacy and merchandise delivery.  The Released Parties assume no responsibility for any injury or damage to entrants’ or to any other person’s computer, regardless of how caused, relating to or resulting from entering or downloading materials or software in connection with this Contest. Entrants and winner(s) acknowledge that Sponsor has neither made nor is in any manner responsible or liable for any warranty, representations or guarantees, express or implied, in fact or in law, relative to any prize or any component thereof.  Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of entrant or Sponsor in connection with the Contest, shall be resolved individually, without resort to any form of class action, and shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules (whether of the State of New York, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York. In addition, any dispute relating to the Contest (including these Terms and Conditions) shall be brought in the appropriate state or federal court having jurisdiction over the subject matter located in New York County, New York. Entrants hereby irrevocably consent to the personal jurisdiction of said courts and waive any claim of forum non conveniens or lack of personal jurisdiction that they may have.  Any and all claims, judgment and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees, and under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and further waives any and all rights to have damages multiplied or otherwise increased.
10. Sponsor.  MCoBeauty Inc., 50 Rockefeller Plaza, Floor 12, New York, NY 10020. This Contest is in no way sponsored, endorsed or administered by, or associated with TikTok.  Any and all questions, comments or complaints regarding the Contest must be directed to Sponsor, not TikTok.
11. Winner List.  The winner list (i.e., the name of the individual Winner) will be available on these Terms and Conditions and posted as a story on Sponsor’s TikTok (@mcobeauty_us) on June 9, 2025.
